Robert, US law enforcement agencies are basically lazy and criminal. I’ve called police while someone was being kidnapped at gun point and was told I could talk to a detective later in the day. Of course they found the body dumped in an alley the next day.

That alone might well exhaust whatever assets were left over after legal expenses. The next obvious thing would be to pay partial back wages, based on years of service regardless of individual circumstances; that would almost certainly use up all of Scientology’s assets, which have been built up on the exploitation of large amounts of nearly free human trafficked labor.
This is also a reminder, that religious organizations should be prohibited from having full-time workers without making adequate retirement provisions. It effectively constitutes a back-door subsidy, because many of those people will end up relying on various sorts of government aid later on.

Scientology is a rather unprecedented case, and I suspect that ultimately there will be some unprecedented – and unpredictable – outcomes. But those may be a long way in the future, at a point when Scientology will likely be much diminished, and perhaps after a protracted and costly battle for survival during which lawyers and others will line their pockets with much of the assets.
Class action lawsuits still have to follow the law. Class action just means that the attorneys get TONS of money while the plaintiffs get much less than an individual lawsuit. This is SETTLED law under SCoTUS. CANNOT happen.

I had a quick look for the most extreme of precedents, and in 1979 California even placed the Worldwide Church of God in receivership under the the state’s charitable-trust law, due to allegations of massive fraud including extravagant spending by leaders – and an appeal was denied by the Supreme Court.
Writing a bunch of individual checks for $1.09 to each person. But, hey, if David Miscavige had to write each individual one, it would be worth it.

Wynski, I’m presuming it would have to come as the result of something like a class-action lawsuit.
If Scientology were ever criminally convicted as a racketeering enterprise, there could also be victim restitution.
Also, if Scientology lost its tax exemption and were ruled to be a business, there would be questions as to what to do with assets acquired under illegitimate religious status.
Scientology is a rather unprecedented case, and I suspect that ultimately there will be some unprecedented – and unpredictable – outcomes. But those may be a long way in the future, at a point when Scientology will likely be much diminished, and perhaps after a protracted and costly battle for survival during which lawyers and others will line their pockets with much of the assets.

Class action lawsuits still have to follow the law. Class action just means that the attorneys get TONS of money while the plaintiffs get much less than an individual lawsuit. This is SETTLED law under SCoTUS. CANNOT happen.

I had a quick look for the most extreme of precedents, and in 1979 California even placed the Worldwide Church of God in receivership under the the state’s charitable-trust law, due to allegations of massive fraud including extravagant spending by leaders – and an appeal was denied by the Supreme Court.

Thanks for the link Wynski. Very interesting. This is going to be a long slow process, but it is going to be fascinating to watch it all unfold. One thing that I have thought about in comparing this case to the Rathbun case is the fact that “Jane Doe” has something going for her that Marty didn’t. BALLS. I’m no legal scholar. not even close, but I can’t see this going well for the cult at all no matter how many wog lawyers they throw at this.

The “funny” thing about good scientologists these days is that if they accidentally see a headline, they won’t see it. They will avert their eyes and psyche. If they accidentally hear about the lawsuit(s), they will avert their ears and not hear it. A really good scientologist (such as Tom Cruise) has their case in such good shape and their overts cleaned up that they won’t even “pull in” knowing about such things as lawsuits against miscavige or the church and if they do commit the overt of listening or seeing, there is a sec check for that.
We, out here, are just part of the wog eat wog world, with our overts and merchants of chaos news organizations that don’t get the wonders of david miscavige and the miracles he is pulling off to bring about a better world where there are no more wogs or merchants of chaos.

This cannot be over emphasized. Most of what I hear on critic’s blogs deride Miscavige as some sort of psycho, evil sociopath. While this may be true, he is also the best thing that ever happened to us ex-culties since Hubbard dropped his meat sack and headed for Target Two. Those of you here with a slight (or major) tendency towards indie scientology, take a few moments tor reflect on how it has been Miscavige’s actions that have driven you out of this cult. If it weren’t for him, you would most likely still be in swilling Kulty Kool-Aid and being all KSW. But, what Hubbard had going is just a con and Miscavige has been very successful in keeping that con going and even expanding on it. You should be down on your knees thanking the little tyrant that you are out of that mind-fuck of a cult once and for all.

Surely, adopting policies which results in most people leaving in droves gives Scientology a losing end game – unless he has some bolt hole prepared and is going to make a run for it at some point.

Here’s my take on it Cavalier. scientology is nothing more than a bait & switch scam. A world class con job. The ‘tech’ doesn’t work 100% of the time on 100% of the people if applied 100% correctly as is claimed. Not even close. That being the case, there has to be some way to keep the con moving forward. That would be scientology ‘ethics tech’. Common sense would have one believe that if something wasn’t expanding, reform is necessary. Since the ‘tech’ is bogus to start with, no amount of reform is going to make it work. That’s where ‘ethics’ comes in. You hook someone into believing that their eternity is at stake and then you can do pretty much anything you want to someone with the club of ‘ethics’ being wielded ruthlessly and at will. The only solution to this is someone has to take the blinders off and LOOK, DON’T LISTEN to what is going on all around them and in their own lives and the cognitive dissonance will cause them enough pain to bail out from this mind-fucking cult. At that point they will see that the cult is nothing but an illusion and they have been trapped in their own prison of belief. Then one has a chance to get on with their life and make of it what they will.
